Report response

The Commissioner for Children’s Inquiry into the circumstances of a 12-year-old child under Guardianship of the Secretary makes findings in relation to Tasmania Police.

One of the findings claim that: Police knew about Gary Devine’s history and knew of his associations with other teenage girls; even if they were unable to arrest Gary Devine there is no evidence they took any steps to disrupt that relationship, or attempted to interview the children away from him; Police may have been able to warn Child Protection Services.

“I am advised that Police records indicate we were not aware of Gary Devine’s association with the 12 year old girl, or any member of her family, until after the prostitution had ceased. At that time, police became aware of contact between Devine and a member of the 12 year old girl’s family,” said Acting Deputy Commissioner, Scott Tilyard.

“As a result of investigations into that matter, police became aware of allegations of prostitution and immediately took action to ensure the safety of the girl and her family. It is through an investigation into that contact that the prostitution was uncovered and charges were laid against Devine and the girl’s mother,” said Mr Tilyard.

The priority of Tasmania Police is public safety, and the Department is willing to examine any opportunity to help protect children from abuse.

Tasmania Police welcomes moves for a more collaborative approach to agencies working together.

“We are exploring opportunities to enhance communication between departments and this can only result in better outcomes for children in our community who are at risk,” said Mr Tilyard.

“In the meantime, Police investigations are continuing into allegations of a relationship between an adult male and another member of the 12-year-old’s family,” said Mr Tilyard.
