Recording in Breach of Privacy
As a result of 4 month investigation into images and recordings located on mobile phones, Detectives from Hobart CIB have commenced proceedings against 4 men in respect of either possession or making recordings in breach of privacy.
Police will allege that on a number on different occasions, unknown to one of the parties involved in sexual conduct, images or video recordings were taken of them.
The following men have been charged and will appear in the Hobart Magistrates Court on 28 January 2014, 11 February and 17 February 2014:
- 18 year old Brighton man will face charges of 15 counts of possession of prohibited visual recordings, 7 counts of recording in breach of privacy and 1 count of assault with indecent intent.
- 18 year old Chigwell man will face charges of 4 counts of possession of prohibited visual recordings and 1 count of distributing a prohibited visual recording.
- 19 year old Chigwell man will face charges of 4 counts of possession of prohibited visual recordings.
- 20 year old Chigwell man with face charges of 5 counts of possession of a prohibited visual recording.
Police would like to remind members of the public that it is an offence to observe or record someone in circumstances where a reasonable person would expect to be afforded privacy, a) without the other person's consent; and b) when the other person is in a private place; or is engaging in a private act and the observation or visual recording is made for the purpose of observing or visually recording that private act.
