New protocols for strip searching of children

Tasmania Police has introduced new protocols relating to the strip searching of children.

 

A review of the protocols was announced in January 2012 following the strip search of a child. While the officers involved in the search acted lawfully, it was decided that the policy in relation to strip searching of children should be examined. 

The protocols in other police jurisdictions were reviewed and the Commissioner for Children was also consulted.

“A strip search of a person under the age of 18 is a rare occurrence and is only undertaken if determined necessary by the seriousness and urgency of the circumstances,” said the Deputy Commissioner of Police, Scott Tilyard.

“The new protocols have been developed to ensure the dignity of the child is protected.”

Under the new protocols:
– the search must have authorisation from an Inspector or Sergeant;
– an officer of the same sex must carry out the strip search in the presence of a parent, guardian or other responsible adult wherever possible; and
– the search must be undertaken in a private location and will not involve the removal of more garments than is necessary.

The new protocols will be included in the Tasmania Police Manual and are effective from today.
